IMPORTANT: PLEASE READ THESE TERMS CAREFULLY

By downloading, installing, accessing, or using Trelio ("App," "Service," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may modify these Terms at any time, and your continued use constitutes acceptance of modifications.

1. AI-POWERED SUPPORT SYSTEM DISCLAIMER

CRITICAL DISCLAIMER - MEDICAL LIABILITY PROTECTION: The AI companion feature in Trelio is NOT a medical device and does NOT provide medical advice, diagnosis, treatment, or mental health intervention.

1.1 What the AI System Is NOT

The AI companion is designed to provide general emotional support and guidance only. It will NOT diagnose, prescribe, provide therapy, or replace professional mental health care or emergency services.

1.2 Limitations and Disclaimers

• Not a Therapist: The AI system is not a licensed mental health professional.
• General Guidance Only: Responses are generated from machine learning models and may contain errors.
• Not Professional Advice: AI suggestions are informational and not personalized clinical advice.
• Not Regulated as Medical Device: Trelio's AI system is not FDA-approved or certified as a medical device.

1.3 Automated Safety Escalation

The AI system includes automated monitoring to detect indicators of severe distress, self-harm, or crisis situations. In such cases the system may escalate your case to emergency services, crisis resources, or mental health professionals without prior notice.

1.4 User Responsibility

By using the AI companion, you acknowledge you understand these limitations, accept risks, and are responsible for seeking professional care when needed.

1.5 Crisis Resources

IF YOU ARE IN CRISIS OR EXPERIENCING SUICIDAL THOUGHTS, DO NOT USE THE AI SYSTEM. IMMEDIATELY CONTACT LOCAL EMERGENCY SERVICES OR THE LISTED RESOURCES.

2. General Service Terms

2.1 Eligibility

You must be at least 18 years old (or have parental consent if 13–18) and have the legal capacity to enter this agreement.

2.2 Account Registration

You are responsible for maintaining confidentiality of login credentials and providing accurate information. You must notify us of unauthorized access.

2.3 Account Responsibility

You are responsible for your conduct on the platform and the content you generate.

3. User Conduct and Prohibited Activities

You agree NOT to use Trelio for illegal purposes, harassment, fraud, malware distribution, scraping, bypassing security, or disrupting the Service. Violations may result in suspension or termination without refund.

4. Medical and Mental Health Disclaimer

4.1 Not Medical Advice

Trelio, including AI chats and peer forums, is for support and information only and does not constitute medical advice or treatment.

4.2 Not a Medical Device

Trelio is not a regulated medical device and is not a replacement for professional care.

4.3 Therapist-User Relationship

Booking a therapist establishes a therapeutic relationship; therapists are independent contractors and responsible for their conduct. Trelio is not liable for therapist actions.

4.4 Your Responsibility

You are responsible for seeking professional care and contacting emergency services in crises.

4.5 No Doctor-Patient Privilege

Communications on Trelio are not subject to doctor-patient privilege unless you are engaged in a formal therapeutic session with a licensed therapist.

5. Peer Support Community Terms

Peer support is provided by community members and is not clinical treatment. Trelio moderates content and may remove dangerous posts.

6. Privacy and Data Protection

Please review our Privacy Policy for details on data collection and use. By using Trelio you consent to data collection as described there.

7. Intellectual Property

Trelio owns all platform content and grants you a limited, non-exclusive license for personal use. You retain ownership of content you post but grant Trelio a license to use it as described.

8. Payment and Subscriptions

Premium features may require payment. Recurring billing, cancellation, and refund rules are detailed here: subscription management occurs in-app or via the app store.

9. Limitation of Liability and Disclaimers

Trelio is provided "AS IS" without warranties. To the maximum extent permitted by law, Trelio is not liable for indirect, incidental, or consequential damages, including emotional distress or worsening mental health.

10. Indemnification

You agree to indemnify Trelio against claims arising from your use of the Service, content you create, or violation of these Terms.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Republic of Kenya. Disputes shall first seek negotiation, then binding arbitration in Nairobi. You waive the right to jury trial and class actions.

12. Termination

You may stop using Trelio at any time. Trelio may suspend or terminate accounts for violations, illegal activity, non-payment, or inactivity. Data handling on termination follows the Privacy Policy.

13. Modifications to Terms

We may modify these Terms; material changes will be posted in-app and via email notification. Continued use constitutes acceptance.

14. Emergency and Safety Procedures

14.1 Crisis Response

If Trelio believes you are in immediate danger, we may escalate information to emergency services or crisis resources and contact emergency contacts if provided.

14.2 User Safety Reporting

Users can report dangerous content; Trelio will investigate and act as permitted by law.

15. Severability

If any provision is invalid, it will be reformed to the minimum extent necessary, and remaining provisions remain in effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trelio regarding the Service.
